Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FurReal mobile application and the website at https://www.furreal.live (together, the "Service"), operated by Las Mascotas, Inc., a Delaware corporation, doing business as FurReal ("FurReal," "we," "us," or "our").

Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to create an account and use the Service. By using the Service, you represent and warrant that:

  • You are 18 years of age or older.

  • You have the legal capacity to enter into these Terms.

  • You will use the Service in compliance with all applicable laws and these Terms.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

If we learn that a user is under 18, we will terminate that account.

2. Your Account

2.1 Account Creation

You may create an account using Apple Sign-In, Google Sign-In, or a phone number verified by SMS. You must provide accurate and current information and keep it updated. 

​

2.2 Account Security

 

You are responsible for safeguarding access to your account. Do not share your sign-in credentials. Notify us immediately at support@furreal.live if you suspect unauthorized access.

You are responsible for all activity that occurs under your account.

​

2.3 One Account per Person

Each individual may maintain only one FurReal account. We may suspend duplicate accounts.

3. Acceptable Use — Zero Tolerance for Objectionable Content & Abusive Users

Zero Tolerance. FurReal has zero tolerance for objectionable content and abusive users. There is no place on FurReal for content that is illegal, sexually explicit, violent, hateful, harassing, or that depicts cruelty to animals, nor for users who harass, bully, threaten, or abuse others. You can report objectionable content or block abusive users at any time from within the app. We review reports and act within 24 hours — removing violating content and suspending or ejecting the responsible users.

 

You agree not to do any of the following on or through the Service:

​

  • Harm or harass others. No threats, harassment, hate speech, doxxing, stalking, or content that promotes self-harm.

  • Sexually explicit, violent, or illegal content. No nudity, sexual content, gore, or content depicting illegal activity. No content that sexualizes minors.

  • Animal cruelty. No content depicting cruelty, neglect, or harm to animals. FurReal exists to celebrate pet companionship; content that violates this purpose is strictly prohibited.

  • Impersonation and misrepresentation. Do not impersonate another person, falsely claim affiliation with FurReal, or misrepresent the source of content.

  • Spam, scraping, and automation. No spam, mass unsolicited messaging, automated scraping, or bots, except as expressly permitted by us.

  • Reverse engineering. Do not decompile, disassemble, or reverse engineer the App except where applicable law expressly permits.

  • Circumvent moderation or rate limits. Do not evade content moderation, account suspensions, or rate limits.

  • Promote competing or unrelated commerce. No promotion of competing platforms or unrelated commercial products without our written permission.

  • Infringe intellectual property. Do not post content you do not own or have permission to use.

  • Compromise security. Do not attempt to gain unauthorized access to the Service, other accounts, or our systems.

These rules are supplemented by our Community Guidelines, which are incorporated into these Terms by reference. We may remove content, suspend accounts, or terminate accounts that violate these rules or the Community Guidelines. We may also report illegal activity to law enforcement.

4. User Content and Licenses

4.1 What "Your Content" Means

​

"Your Content" means any content you submit to the Service, including livestream video and audio, profile and pet photos, usernames, pet descriptions, chat messages, and reports.

 

4.2 Ownership

​

You retain ownership of Your Content.

 

4.3 License to FurReal

​

You grant FurReal a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, transmit, display, reproduce, modify (for technical purposes such as transcoding), and distribute Your Content solely for the purpose of operating and improving the Service. This license ends when you or we delete the content, except that:

  • We may retain backup copies for a reasonable period (see our Privacy Policy).

  • Aggregated, anonymized data derived from Your Content may be retained indefinitely.

  • Recipients of gifts you send retain a record of the transaction.

 

4.4 License to Other Users

​

When you broadcast a livestream or post content visible to other users, you also grant other users the right to view, share within the Service, and (where applicable) record their own viewing experience as part of normal Service use.

 

4.5 Feedback

​

If you send us suggestions or feedback, you grant FurReal an unlimited, royalty-free license to use them without obligation.

 

4.6 Content Moderation

​

We use automated content moderation (provided by Tencent Cloud) to detect prohibited content. We may also review content based on user reports or our own observations. We may remove content, mute or limit features, or suspend or terminate accounts at our discretion.

We are not obligated to monitor all content, and we are not responsible for content posted by users.

5. FurCoin and Treats

5.1 FurCoin and Treats

 

"FurCoin" is the virtual currency used within the Service. "Treats" are virtual gift items (for example, pet-themed treats) that you can send to broadcasters during livestreams. You use FurCoin to send Treats. FurCoin is licensed to you, not sold, and represents a limited right to access features of the Service.

 

5.2 No Cash Value

 

FurCoin and Treats have no cash value, are not your property, and are not a bank deposit or stored-value instrument.

FurCoin is not transferable between accounts and cannot be exchanged for cash or other value outside the Service, except that eligible FurCoin may be redeemed for rewards as expressly described in Section 6.

 

5.3 How You Obtain FurCoin

 

We grant FurCoin for free. Your FurCoin balance may include:

  •  Promotional FurCoin (shown in the App as "Perk FurCoin"): FurCoin we grant for free, such as for signing up, daily check-ins, or referrals, subject to limits we set Promotional FurCoin expires 45 days after it is granted and is not redeemable for cash.

  • Earned FurCoin (shown in the App as your "Stream Earnings"): FurCoin a broadcaster receives when viewers send them Treats. Earned FurCoin does not expire on a rolling basis, but may be cleared when the launch-period program ends (see Section 5.4), and is subject to Section 6. When you send a Treat, we apply your Promotional (Perk) FurCoin first, so that your Earned FurCoin is used last. FurCoin we grant or that you earn is not refundable.

5.4 Changes and Launch-Period Program

 

We may change FurCoin and Treats offers, exchange values, expiration rules, and availability at any time. The current FurCoin program is a launch-period program; when we move to a new coin system, the program will end, and we will give you at least two weeks' notice beforehand.

 

5.5 Termination Effect

 

If your account is terminated for violation of these Terms, you forfeit any unused FurCoin balance (including Promotional and Earned FurCoin) and any pending redemptions, to the extent permitted by law.

6. Earnings and Redemption

6.1 Eligibility

 

If you accumulate FurCoin — including Earned FurCoin you receive as a broadcaster when viewers send you Treats — you may become eligible to redeem eligible FurCoin for rewards, such as electronic gift cards, subject to:

  •  Maintaining an account in good standing.

  • Reaching the redemption thresholds (tiers) we set.

  • Verifying your identity and tax information where required.

  • Complying with all applicable laws, including tax reporting.

 

6.2 No Guarantee

 

Redemption rewards are provided as electronic gift cards (or other non-cash rewards we may offer). Redemption is a discretionary benefit, offered subject to applicable law and void where prohibited. We do not guarantee that any FurCoin will become redeemable, that any particular reward will be available, or that exchange values or thresholds will remain unchanged. We may modify or discontinue the redemption program at any time.

 
6.3 Redeemable Balance

 

Redemption eligibility and deductions are based on your current redeemable FurCoin balance. When you spend FurCoin, Promotional (Perk) FurCoin is used before Earned FurCoin, and expired Promotional FurCoin is not redeemable. Lifetime statistics shown in the App (such as total Treats received) are for display only and do not by themselves determine redeemable value.

 

6.4 Fulfillment

 

Approved redemptions are fulfilled as electronic gift cards delivered by email to the address you provide with your request. You are responsible for providing a correct email address. We may set processing times and may require additional verification before fulfilling a redemption.

 

6.5 Taxes

 

You are responsible for any taxes owed on rewards you receive. We may withhold or report amounts as required by law.

 

6.6 Suspicion of Fraud

 

If we suspect fraud, abuse, money laundering, or violations of these Terms, we may freeze, withhold, reverse, or deny redemptions or FurCoin while we investigate.

7. Intellectual Property

7.1 FurReal IP

 

The Service, including the FurReal name, logo, app interface, design, code, and content we create, is owned by FurReal and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial use, subject to these Terms.

 

7.2 Reservation of Rights

 

All rights not expressly granted in these Terms are reserved.

 

7.3 Copyright Complaints

 

If you believe content on the Service infringes your copyright, send a notice to our designated agent that includes:

  •  A description of the work you claim has been infringed.

  • A description of the allegedly infringing material and where it is on the Service.

  • Your contact information.

  • A statement that you have a good-faith belief the use is not authorized.

  • A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

  • Your physical or electronic signature.

 

We will respond consistent with the U.S. Digital Millennium Copyright Act. Send copyright notices to our designated agent:

7.4 Counter-Notification

 

If you believe your content was removed by mistake or misidentification, you may send a counter-notification to the agent above that includes: (a) your physical or electronic signature; (b) identification of the removed content and the location where it appeared before removal; (c) a statement, under penalty of perjury, that you have a good-faith belief the content was removed as a result of mistake or misidentification; (d) your name, address, and telephone number; and (e) a statement that you consent to the jurisdiction of the federal court for the district of your address (or, if outside the United States, the courts identified in Section 13), and that you will accept service of process from the party who filed the original notice. We may restore the content as permitted by the DMCA.

 

7.5 Repeat Infringers

 

We will, in appropriate circumstances, suspend or terminate the accounts of users who are repeat infringers.

8. Third-Party Services and Links

The Service relies on or interoperates with third-party services (including Apple, Google, Meta, Tencent Cloud, and Amazon Web Services). Use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.

The Service may contain links to third-party sites or content. We are not responsible for those sites or their content.

9. Termination

9.1 By You

 

You may stop using the Service at any time by deleting your account (see our Data Deletion Instructions at

  https://www.furreal.live/data-deletion).

 

9.2 By Us 

 

We may suspend or terminate your account or access to the Service at any time, with or without notice, including if we

  believe you have violated these Terms, posed a risk to other users or to FurReal, or engaged in fraud.

 

9.3 Effect of Termination

 

Upon termination:

  • Your right to use the Service ends.

  • We may delete Your Content and account data, subject to the retention periods in our Privacy Policy.

  • Sections that by their nature should survive termination (including Sections 3, 4.3, 5.5, 6, 7, 10, 11, 12, and 13) survive.

10. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. 

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT POSTED BY USERS.

Some jurisdictions do not allow the exclusion of certain warranties; the above exclusions may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • IN NO EVENT WILL FURREAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. 

  • OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

 

These limitations apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow the limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless FurReal and its officers, directors, employees, and agents from any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service.

  • Your violation of these Terms.

  • Your Content.

  • Your violation of any third-party right, including any intellectual property or privacy right.

13. Governing Law and Disputes

13.1 Governing Law  

 

These Terms and any dispute arising from or relating to them or to the Service are governed by the laws of the State of Delaware, U.S.A., without regard to conflict-of-law principles.

 

13.2 Informal Resolution

 

Before filing any formal claim, you agree to try to resolve the dispute informally by contacting support@furreal.live. We will try to resolve the dispute within 60 days of receipt.

 

13.3 Venue

 

If informal resolution fails, you agree that any legal action must be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to the personal jurisdiction of those courts.

 

13.4 Class Action Waiver

 

To the extent permitted by law, you and FurReal each agree that disputes will be resolved on an individual basis only, and not as part of any class, collective, or representative action.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. If we make material changes, we will notify you through the App or by email before the change takes effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. General

15.1 Entire Agreement

 

These Terms, together with our Privacy Policy, are the entire agreement between you and FurReal regarding the Service and supersede any prior agreements.

 

15.2 Severability   

 

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.

 

15.3 No Waiver

 

Our failure to enforce any right or provision is not a waiver of that right or provision.

 

15.4 Assignment

 

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

 

15.5 No Agency

 

These Terms do not create any agency, partnership, employment, or fiduciary relationship.

 

15.6 Changes to the Service

 

We may modify, suspend, or discontinue the Service or any feature, in whole or in part, at any time and without liability. We will use reasonable efforts to notify you of material changes that significantly reduce the core functionality of the Service.  

 

15.7 Electronic Communications

 

You consent to receive communications from us electronically, including notices about these Terms, your account, and the Service, by email or through the App. Electronic communications satisfy any legal requirement that a communication be in writing.  

16. Apple-Specific Terms

If you obtained the App from the Apple App Store, the following terms also apply, in addition to the rest of these Terms:

  • These Terms are between you and FurReal only, not Apple. Apple is not responsible for the App or its content.

  • Apple has no obligation to provide maintenance or support for the App.

  • In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation.

  • FurReal, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.

  • FurReal, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your use of the App infringes that third party's intellectual property rights.

  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you.

17. Content License and Media Release

17.1. Ownership of Content

 

You retain ownership of all photos, videos, livestreams, recordings, comments, and other content ("Content") that you create, upload, post, or broadcast through FurReal.

 

17.2. License Granted to FurReal

 

By creating, uploading, posting, or live streaming Content on FurReal, you grant FurReal, its affiliates, successors, partners, contractors, and service providers a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

  • host, store, reproduce, copy, process, modify, edit, adapt, translate, publish, distribute, display, perform, transmit, stream, and otherwise use your Content;

  • create excerpts, screenshots, highlight clips, compilations, promotional videos, advertisements, and other derivative works based on your Content;

  • use your Content for the operation, improvement, promotion, marketing, advertising, publicity, education, public relations, and demonstration of FurReal and its services;

  • display or distribute your Content through FurReal, websites, social media platforms, email campaigns, digital advertisements, presentations, press releases, app store listings, and other online or offline promotional channels.

 

This license remains in effect until the Content is removed from FurReal, except that FurReal may continue to use copies or promotional materials created before removal and may retain archived copies as reasonably necessary for legal, security, backup, or operational purposes.

 

17.3. Username, Profile, and Pet Likeness

 

You also authorize FurReal to use your:

  • username;

  • display name;

  • profile picture;

  • business name (if applicable);

  • business logo (if provided);

  • pet's name;

  • pet's likeness, appearance, sounds, and personality as captured in your Content; solely in connection with promoting FurReal and its services.

 

17.4. Promotional Use

 

You acknowledge and agree that FurReal may:

  • feature your livestreams or recordings on its homepage or within the app;

  • create short promotional clips from your livestreams;

  • edit Content for length, formatting, subtitles, branding, or technical quality;

  • use screenshots or still images from your Content;

  • include your Content in marketing campaigns, advertisements, social media posts, press materials, presentations, investor materials, newsletters, and similar promotional communications.

 

FurReal has no obligation to use any Content.

 

17.5. No Compensation

 

Unless otherwise agreed in writing, you understand and agree that you will not receive compensation, royalties, residuals, or other payment for FurReal's use of your Content under this license.

17.6. Your Representations

 

You represent and warrant that:

  • you own or otherwise have all necessary rights to the Content you submit;

  • you have authority to grant the licenses described in these Terms;

  • your Content does not infringe the intellectual property, privacy, publicity, or other legal rights of any person or entity;

  • if any identifiable person appears in your Content, you have obtained all permissions or consents necessary for FurReal to use the Content as described in these Terms;

  • if your Content features client-owned pets, foster animals, shelter animals, or animals owned by another person or organization, you have obtained any permissions reasonably necessary to publish and grant this license;

  • your Content complies with all applicable laws and these Terms.

17.7. Third-Party Content

 

If your livestream or Content includes music, artwork, trademarks, copyrighted material, or other third-party content, you are responsible for ensuring that you have the necessary rights or permissions to use such material.

17.8. Removal of Content

 

You may delete your Content or your account in accordance with these Terms. Removal of Content will stop future public display on FurReal where reasonably practicable but will not affect:

  • Content already shared or reposted by other users in accordance with these Terms;

  • promotional materials created before removal;

  • backup, security, legal compliance, or archival copies retained by FurReal.

 

17.9. Reservation of Rights

 

Except for the license expressly granted in these Terms, all ownership rights in your Content remain with you.

 

Nothing in these Terms transfers ownership of your Content to FurReal.

18. Live Streaming Rules & Community Guidelines

18.1. Purpose of FurReal


FurReal is a live streaming community dedicated to pets, animals, animal welfare, and responsible pet ownership. Users are expected to create a safe, welcoming, and respectful environment for all members.


18.2. User Responsibility


You are solely responsible for all livestreams, recordings, comments, messages, and other Content you create or share on FurReal.


You agree that your Content will comply with these Terms, applicable laws, and FurReal's Community Guidelines.


18.3. Prohibited Content


You may not use FurReal to:

  • engage in harassment, bullying, hate speech, or discrimination;

  • threaten, intimidate, or encourage violence;

  • post obscene, sexually explicit, or pornographic material;

  • depict or promote animal abuse, neglect, cruelty, or animal fighting;

  • engage in dangerous or illegal activities involving animals;

  • sell, broker, auction, or facilitate the sale of live animals unless expressly authorized by FurReal;

  • promote illegal products or services;

  • infringe another person's intellectual property or privacy rights;

  • impersonate another individual or organization;

  • artificially inflate views, gifts, followers, or engagement through bots or deceptive practices;

  • distribute spam, scams, or misleading information.


18.4. Livestream Conduct


While broadcasting, you agree to:

  • maintain a respectful environment;

  • comply with all applicable animal welfare laws;

  • ensure animals shown are treated humanely;

  • avoid intentionally distressing or provoking animals for entertainment;

  • avoid broadcasting dangerous, abusive, or unsafe behavior.


18.5. Moderation


FurReal may monitor, review, restrict, suspend, remove, age-restrict, or terminate any livestream or account that violates these Terms or may harm users, animals, or the platform.

FurReal may take such action with or without prior notice.


18.6. Reporting


Users may report Content they believe violates these Terms.

FurReal may investigate reports and take action at its sole discretion.

19.Virtual Gifts, FurCoin, Rewards, and Creator Programs

19.1. Virtual Items


FurCoin, virtual gifts, rewards, badges, and similar digital items are licensed—not sold—to users for use solely within the FurReal platform.

Virtual items have no cash value unless expressly stated by FurReal.


19.2. Platform Discretion


FurReal may modify, suspend, discontinue, replace, expire, or cancel any virtual item, rewards program, creator incentive, or monetization feature at any time.


19.3. No Property Rights


Users do not acquire ownership rights in FurCoin, virtual gifts, badges, rankings, creator levels, or similar platform features.

These items cannot be transferred, sold, exchanged, inherited, or redeemed except as expressly permitted by FurReal.


19.4. Rewards and Incentives


From time to time FurReal may offer:

  • creator bonuses;

  • livestream rewards;

  • contests;

  • promotional incentives;

  • referral rewards;

  • gift card promotions;

  • or other campaigns.

Participation is subject to the rules of each promotion.

FurReal reserves the right to modify, suspend, or cancel any promotion at any time.


19.5. Fraudulent Activity


FurReal may withhold, reduce, revoke, or recover rewards if it reasonably believes a user has:

  • manipulated platform metrics;

  • engaged in fraudulent activity;

  • used fake accounts;

  • exchanged gifts for compensation outside FurReal;

  • violated these Terms.


19.6. Taxes


Users are solely responsible for any taxes arising from rewards or payouts they receive.
