FURREAL TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the FurReal mobile application and the website at https://www.furreal.live (together, the "Service"), operated by Las Mascotas, Inc., a Delaware corporation, doing business as FurReal ("FurReal," "we," "us," or "our").
Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years of age to create an account and use the Service. By using the Service, you represent and warrant that:
- You are 18 years of age or older.
- You have the legal capacity to enter into these Terms.
- You will use the Service in compliance with all applicable laws and these Terms.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.
2. Your Account
2.1 Account Creation
You may create an account using Apple Sign-In, Google Sign-In, Facebook Login, or a phone number verified by SMS. You must provide accurate and current information and keep it updated.
2.2 Account Security
You are responsible for safeguarding access to your account. Do not share your sign-in credentials. Notify us immediately at support@furreal.live if you suspect unauthorized access.
You are responsible for all activity that occurs under your account.
2.3 One Account per Person
Each individual may maintain only one FurReal account. We may suspend duplicate accounts.
3. Acceptable Use
You agree not to do any of the following on or through the Service:
- Harm or harass others. No threats, harassment, hate speech, doxxing, stalking, or content that promotes self-harm.
- Sexually explicit, violent, or illegal content. No nudity, sexual content, gore, or content depicting illegal activity. No content that sexualizes minors.
- Animal cruelty. No content depicting cruelty, neglect, or harm to animals. FurReal exists to celebrate pet companionship; content that violates this purpose is strictly prohibited.
- Impersonation and misrepresentation. Do not impersonate another person, falsely claim affiliation with FurReal, or misrepresent the source of content.
- Spam, scraping, and automation. No spam, mass unsolicited messaging, automated scraping, or bots, except as expressly permitted by us.
- Reverse engineering. Do not decompile, disassemble, or reverse engineer the App except where applicable law expressly permits.
- Circumvent moderation or rate limits. Do not evade content moderation, account suspensions, or rate limits.
- Promote competing or unrelated commerce. No promotion of competing platforms or unrelated commercial products without our written permission.
- Infringe intellectual property. Do not post content you do not own or have permission to use.
- Compromise security. Do not attempt to gain unauthorized access to the Service, other accounts, or our systems.
We may remove content, suspend accounts, or terminate accounts that violate these rules. We may also report illegal activity to law enforcement.
4. User Content and Licenses
4.1 What "Your Content" Means
"Your Content" means any content you submit to the Service, including livestream video and audio, profile and pet photos, usernames, pet descriptions, chat messages, and reports.
4.2 Ownership
You retain ownership of Your Content.
4.3 License to FurReal
You grant FurReal a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, transmit, display, reproduce, modify (for technical purposes such as transcoding), and distribute Your Content solely for the purpose of operating and improving the Service. This license ends when you or we delete the content, except that:
- We may retain backup copies for a reasonable period (see our Privacy Policy).
- Aggregated, anonymized data derived from Your Content may be retained indefinitely.
- Recipients of gifts you send retain a record of the transaction.
4.4 License to Other Users
When you broadcast a livestream or post content visible to other users, you also grant other users the right to view, share within the Service, and (where applicable) record their own viewing experience as part of normal Service use.
4.5 Feedback
If you send us suggestions or feedback, you grant FurReal an unlimited, royalty-free license to use them without obligation.
4.6 Content Moderation
We use automated content moderation (provided by Tencent Cloud) to detect prohibited content. We may also review content based on user reports or our own observations. We may remove content, mute or limit features, or suspend or terminate accounts at our discretion.
We are not obligated to monitor all content, and we are not responsible for content posted by users.
5. Virtual Currency and Gifts
5.1 What "Treats" Are
The Service uses a virtual currency called "Treats." Treats can be sent to broadcasters as virtual gifts during livestreams.
5.2 No Cash Value
Treats have no cash value, are not transferable between accounts, and cannot be exchanged for cash, goods, or services outside the Service except as expressly described in Section 6 (Broadcaster Earnings).
5.3 Two Balance Types
Your Treats balance is composed of two parts:
- Paid balance: Treats you obtain through future in-app purchases (when made available). Paid balances are subject to the App Store's refund policy.
- Bonus balance: Treats granted promotionally (for example, on signup or as a reward). Bonus balances expire 7 days after they are granted and are non-refundable and non-redeemable for cash or any other value.
When you send a gift, FurReal applies your bonus balance first.
5.4 No Refunds
Except where required by law or by Apple's App Store policy:
- Paid Treats are non-refundable once they have been used (sent as a gift).
- Bonus Treats are never refundable.
- Refunds for unused paid Treats must be requested through Apple, not from FurReal.
5.5 Pricing and Availability
We may change Treats prices, offers, and availability at any time without notice. Changes are not retroactive to Treats you have already obtained.
5.6 Termination Effect
If your account is terminated for violation of these Terms, you forfeit any unused Treats balance.
6. Broadcaster Earnings and Redemption
6.1 Eligibility
If you broadcast on the Service and receive Treats from viewers, you may become eligible to redeem a portion of those Treats for real-world value, subject to:
- Maintaining an account in good standing.
- Meeting cumulative earning thresholds we set.
- Verifying your identity and tax information where required.
- Complying with all applicable laws, including tax reporting.
6.2 No Guarantee
We do not guarantee that any Treats you receive will become redeemable, or that the conversion rate will remain unchanged. We may modify the redemption program at any time.
6.3 Redemption Restrictions
Treats received from your bonus balance of senders contribute only to popularity metrics and are not redeemable. Only Treats received from senders' paid balances count toward your redeemable earnings.
6.4 Withdrawals
Approved redemptions are paid via the methods we make available (which may include bank transfer, payment processor, or App Store credit, depending on your region). We may charge processing fees, which we will disclose before you confirm the withdrawal.
6.5 Taxes
You are responsible for any taxes owed on amounts you receive. We may withhold or report amounts as required by law.
6.6 Suspicion of Fraud
If we suspect fraud, money laundering, or violations of these Terms, we may freeze, withhold, or reverse redemptions while we investigate.
7. Intellectual Property
7.1 FurReal IP
The Service, including the FurReal name, logo, app interface, design, code, and content we create, is owned by FurReal and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial use, subject to these Terms.
7.2 Reservation of Rights
All rights not expressly granted in these Terms are reserved.
7.3 Copyright Complaints
If you believe content on the Service infringes your copyright, send a notice to support@furreal.live that includes:
- A description of the work you claim has been infringed.
- A description of the allegedly infringing material and where it is on the Service.
- Your contact information.
- A statement that you have a good-faith belief the use is not authorized.
- A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
We will respond consistent with the U.S. Digital Millennium Copyright Act.
8. Third-Party Services and Links
The Service relies on or interoperates with third-party services (including Apple, Google, Meta, Tencent Cloud, and Amazon Web Services). Use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
The Service may contain links to third-party sites or content. We are not responsible for those sites or their content.
9. Termination
9.1 By You
You may stop using the Service at any time by deleting your account (see our Data Deletion Instructions (https://www.furreal.live/data-deletion)).
9.2 By Us
We may suspend or terminate your account or access to the Service at any time, with or without notice, including if we believe you have violated these Terms, posed a risk to other users or to FurReal, or engaged in fraud.
9.3 Effect of Termination
Upon termination:
- Your right to use the Service ends.
- We may delete Your Content and account data, subject to the retention periods in our Privacy Policy.
- Sections that by their nature should survive termination (including Sections 4.3, 5.6, 7, 10, 11, 12, and 13) survive.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT POSTED BY USERS.
Some jurisdictions do not allow the exclusion of certain warranties; the above exclusions may not apply to you.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- IN NO EVENT WILL FURREAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
- OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
These limitations apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow the limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless FurReal and its officers, directors, employees, and agents from any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your Content.
- Your violation of any third-party right, including any intellectual property or privacy right.
13. Governing Law and Disputes
13.1 Governing Law
These Terms and any dispute arising from or relating to them or to the Service are governed by the laws of the State of Delaware, U.S.A., without regard to conflict-of-law principles.
13.2 Informal Resolution
Before filing any formal claim, you agree to try to resolve the dispute informally by contacting support@furreal.live. We will try to resolve the dispute within 60 days of receipt.
13.3 Venue
If informal resolution fails, you agree that any legal action must be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to the personal jurisdiction of those courts.
13.4 Class Action Waiver
To the extent permitted by law, you and FurReal each agree that disputes will be resolved on an individual basis only, and not as part of any class, collective, or representative action.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. If we make material changes, we will notify you through the App or by email before the change takes effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. General
15.1 Entire Agreement
These Terms, together with our Privacy Policy, are the entire agreement between you and FurReal regarding the Service and supersede any prior agreements.
15.2 Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
15.3 No Waiver
Our failure to enforce any right or provision is not a waiver of that right or provision.
15.4 Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
15.5 No Agency
These Terms do not create any agency, partnership, employment, or fiduciary relationship.
16. Apple-Specific Terms
If you obtained the App from the Apple App Store, the following terms also apply, in addition to the rest of these Terms:
- These Terms are between you and FurReal only, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation.
- FurReal, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- FurReal, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your use of the App infringes that third party's intellectual property rights.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you.
